These Terms and Conditions set out the basis on which Waste Collection Chiswick provides waste collection and related services in the United Kingdom. By booking or using our services, you agree to be bound by these Terms and Conditions. Please read them carefully before placing any booking.
1. Definitions
In these Terms and Conditions, the following expressions have the meanings set out below:
Customer means the individual, business, organisation or other party who places a booking or uses our waste collection services.
Company, we, us, our means Waste Collection Chiswick, the provider of waste collection and associated services.
Services means any waste collection, removal, transportation, loading, sorting, or related services that we agree to provide to the Customer.
Waste means any materials, items or goods that the Customer asks us to collect, remove or transport as part of the Services.
2. Scope of Services
We provide waste collection and related services for domestic, commercial and other premises, including but not limited to the collection, loading and transportation of general waste, bulky items, garden waste and certain types of recyclable materials. The exact scope of the Services will be as described in the booking confirmation or as otherwise agreed in writing between the Customer and the Company.
We reserve the right to decline any request for Services if the Waste is unsuitable, restricted by law, unsafe to handle, or beyond our operational capacity. We may also refuse to carry out any work that, in our reasonable opinion, poses a health and safety risk to our staff, contractors or the public.
3. Booking Process
Bookings for waste collection can be made by telephone, email or through any online booking system we may operate. The Customer must provide accurate and complete information, including but not limited to:
1. Full name and contact details of the Customer
2. Collection address and any access restrictions
3. Description, approximate quantity and type of Waste
4. Preferred date and time window for collection
5. Any special requirements or site-specific information
All bookings are subject to availability and are not confirmed until we have provided a booking confirmation. We may issue a booking reference or written confirmation setting out the agreed Services, charges and any specific terms that apply.
The Customer is responsible for checking that the booking details are correct. Any amendments must be requested as soon as possible and may be subject to additional charges or changes to the scheduled collection time.
4. Access and Service Conditions
The Customer must ensure that our collection team has safe, reasonable and unobstructed access to the collection point at the agreed time. This includes ensuring that:
1. Any gates or doors are unlocked or access codes provided in advance
2. Vehicles can park or stop legally and safely near the collection point
3. The Waste is ready for collection and is easily identifiable
4. There are no hazards that could cause injury or damage, such as aggressive animals, unsafe structures or dangerous terrain
If we are unable to carry out the Services due to lack of access, unsafe conditions or incorrect information supplied by the Customer, we may charge a call-out or wasted journey fee. We may, at our discretion, attempt to rearrange the collection for a later time or date, which may also incur additional charges.
5. Customer Responsibilities
The Customer is responsible for:
1. Ensuring that all Waste presented for collection is accurately described and is suitable for collection under these Terms and Conditions
2. Separating Waste types if requested, for example segregating recyclable materials from general waste
3. Complying with any instructions we provide about how to present or package the Waste
4. Ensuring that no prohibited or hazardous items are included in the Waste unless we have expressly agreed in writing to handle them and all legal requirements have been satisfied
The Customer warrants that they either own the Waste or have the authority of the owner to arrange for its removal and disposal.
6. Waste Types and Prohibited Items
We collect most common household and commercial waste streams. However, certain wastes are prohibited or restricted by law or by our internal policies. These may include but are not limited to:
1. Asbestos or materials containing asbestos
2. Clinical, medical or biological waste
3. Chemical, corrosive, flammable or explosive substances
4. Gas bottles, pressurised containers and fuel tanks containing fuel
5. Liquids including oils, paints, solvents and similar substances, unless we have specifically agreed to handle them
6. Radioactive or highly toxic materials
7. Any other items classified as hazardous or requiring specialist handling and disposal
If we discover prohibited items in the Waste, we may refuse collection of all or part of the Waste, charge additional fees for handling or safe disposal, or require the Customer to remove such items from the collection. The Customer will be liable for any costs, fines or penalties incurred by us as a result of prohibited items being included in the Waste.
7. Pricing and Quotations
Our charges may be based on one or more of the following:
1. Volume of Waste collected
2. Weight of Waste collected
3. Type of Waste and disposal route required
4. Labour time for loading or sorting
5. Access difficulties, additional staffing or specialist equipment
6. Distance travelled and any parking or permit charges
Any quotation provided before collection is an estimate only and is subject to inspection of the Waste and site conditions on arrival. If the actual Waste or conditions differ from the information provided at the time of booking, we may revise the price. We will notify the Customer of any price change before proceeding. If the Customer does not accept the revised price, we may cancel the Services and charge a call-out fee where applicable.
8. Payments and Invoicing
Unless otherwise agreed in writing, payment is due on or before completion of the Services. We may accept payment by cash, card, bank transfer or other methods we specify from time to time. For business Customers, we may issue an invoice with agreed payment terms. All invoices must be paid in full by the due date stated.
We reserve the right to request a deposit or full payment in advance, especially for larger collections, specialist services or new business accounts. Where payment is not received on time, we may charge interest on overdue amounts at the statutory rate together with any reasonable costs incurred in pursuing payment.
The Customer is responsible for any bank charges, card charges or transaction fees associated with their chosen method of payment.
9. Cancellations and Rescheduling
The Customer may cancel or reschedule a booking by contacting us during our normal business hours. The following terms will apply unless otherwise agreed in writing:
1. Cancellations or rescheduling with at least 24 hours notice before the scheduled collection time may be made without charge.
2. Cancellations or rescheduling with less than 24 hours notice may incur a cancellation fee or partial charge, reflecting the costs we have incurred in allocating staff and vehicles.
3. If our team arrives at the site and is unable to perform the Services due to reasons within the Customer s control, including lack of access or Waste not being available, we may charge a call-out or wasted journey fee.
We reserve the right to cancel or reschedule the Services in the event of unforeseen circumstances, including but not limited to vehicle breakdown, staff illness, extreme weather, or events outside our reasonable control. In such cases, we will aim to notify the Customer as soon as possible and arrange an alternative time. We will not be liable for any loss arising from such cancellation or rescheduling.
10. Performance and Timeframes
We will make reasonable efforts to carry out the Services on the agreed date and within any indicated time window. However, any dates or times given are estimates only and do not form a binding obligation. We are not liable for delays caused by traffic, weather, access issues, operational problems or other factors beyond our reasonable control.
If we anticipate that we will be significantly delayed, we will try to contact the Customer using the details provided at the time of booking. The Customer should ensure they are reachable on the day of collection.
11. Disposal and Recycling
We will transport collected Waste to appropriately licensed facilities for transfer, recycling, recovery or disposal, in compliance with applicable waste management and environmental regulations. We aim to maximise recycling and diversion from landfill where reasonably practicable, but we do not guarantee that any particular item or proportion of the Waste will be recycled.
Once the Waste has been loaded onto our vehicle and payment has been made or confirmed, ownership of the Waste generally transfers to us, except where otherwise required by law or agreed in writing.
12. Compliance with Waste Regulations
We operate in accordance with relevant UK waste legislation and environmental regulations. Where required, we will issue appropriate documentation such as waste transfer notes to record movements of non hazardous waste. For certain types of controlled or hazardous waste, additional documentation and procedures may be required and may incur extra charges.
The Customer agrees to provide any information reasonably required to ensure legal and regulatory compliance, including accurate descriptions of Waste, confirmation of its origin, and any relevant safety data. The Customer will be responsible for any consequences arising from incorrect, incomplete or misleading information they provide.
13. Limitation of Liability
Nothing in these Terms and Conditions limits or excludes our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot be excluded or limited by law.
Subject to the above, our total liability to the Customer for any loss or damage arising out of or in connection with the Services, whether in contract, tort including negligence or otherwise, shall be limited to the total amount paid or payable by the Customer for the specific Services giving rise to the claim.
We will not be liable for:
1. Any indirect, consequential or economic loss, including loss of profit, business, revenue, opportunity or goodwill
2. Any loss arising from delays, cancellations or rescheduling of the Services, except to the extent caused by our breach of contract or negligence
3. Damage to property or belongings that results from inadequate packaging, unsafe loading conditions, concealed defects, or the Customer s failure to follow our instructions
The Customer is responsible for taking reasonable steps to protect property and belongings in areas where our team will be working, including covering floors or fragile surfaces and removing vulnerable items from access routes.
14. Insurance
We maintain insurance cover that is appropriate for the nature of our operations, including public liability insurance. Details of our insurance can be provided on request. The existence of insurance does not extend or increase our liability beyond the limits set out in these Terms and Conditions.
15. Complaints
If the Customer has any concerns or complaints about the Services, they should contact us as soon as possible, providing full details and any supporting information. We will investigate the matter and aim to respond promptly. To enable us to address issues effectively, complaints regarding a specific collection should normally be made within a reasonable time after the Services have been provided.
16. Data Protection
We will use personal information provided by the Customer only for purposes connected with the provision of the Services, administration of the account, and where applicable to comply with legal obligations. We will take reasonable steps to keep such information secure and will not sell or disclose it to third parties except as required for service delivery, debt recovery, or as required by law.
17. Force Majeure
We will not be in breach of these Terms and Conditions, nor liable for any delay in performing, or failure to perform, any of our obligations where such delay or failure results from events, circumstances or causes beyond our reasonable control. This may include but is not limited to extreme weather, strikes, lock outs, industrial disputes, accidents, road closures, acts of terrorism, natural disasters, or failure of utilities or transport networks.
18. Variation of Terms
We reserve the right to update or amend these Terms and Conditions from time to time. Any changes will take effect when published or communicated to the Customer and will apply to subsequent bookings and Services. The version of the Terms and Conditions in force at the time of the booking will normally apply to that booking.
19. Severability
If any provision of these Terms and Conditions is found to be invalid, unlawful or unenforceable by a court or competent authority, that provision shall be deemed severed from the remaining provisions, which shall continue to be valid and enforceable to the fullest extent permitted by law.
20. Governing Law and Jurisdiction
These Terms and Conditions, and any dispute or claim arising out of or in connection with them or with the Services, whether contractual or non contractual, shall be governed by and construed in accordance with the laws of England and Wales.
The courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms and Conditions or the Services.
21. Entire Agreement
These Terms and Conditions, together with any written booking confirmation or other written agreement between the Customer and the Company, constitute the entire agreement between the parties in relation to the Services. The Customer acknowledges that they have not relied on any statement, promise or representation that is not set out in these Terms and Conditions or in a written agreement signed or issued by us.
